Customer Acknowledgment.
Customer acknowledges agreement with these Terms of Sale by the placement of an order to purchase a Product from iRepair Team

  1. Policy regarding music and data files stored on device. irepairteam will not be held responsible or liable for the loss of any data regardless of how caused. The customer is responsible for backing up all information before the product is sent in for repair.
  2. Abandonment Policy. iPods shipped to irepairteam will be held for no longer than 90 days after receipt and completion of free diagnosis. If notification from customer is not received to go ahead with repair and payment is not received, then irepairteam will return the device to the shipping address on file. If additional service requests are made after payment has been received for original repair and then if irepairteam does not receive payment for the additional repair, then irepairteam will allow up to 90 days for a response regarding payment for additional repairs requested. After 90 days, we will assume property of abandoned iPod.
  3. All Sales Made In Arizona. All sales shall be deemed made in the State of Arizona, USA, regardless of the location of the Customer.
    The Customer agrees that any dispute with iRepair Team out of the Customer's purchase from iRepair Team shall be brought by the Customer exclusively in the state or federal courts situated in the State of Arizona; and the Customer hereby agrees that such venue is appropriate and that iRepair Teams agreement to sell and deliver products to the Customer is dependent on this provision.
  4. Purchase Price (a) Prices are listed in irepairteam's advertisements and web site, and are subject to change without notice. Prices for certain governmental, corporate, and institutional customers may be set forth in a bid or other written agreement between the parties. (b) Payment is due before shipment, unless credit terms have been arranged in advance with irepairteam Credit Department. In such case, payment terms shall be as set forth in the credit agreement.

Vendor License Agreements.
Customer agrees to abide by all license provisions or end user agreement imposed by the manufacturer or publisher.

  1. LIMITATION OF LIABILITY.
    In no event shall irepairteam be liable for special, incidental, or consequential damages, including but not limited to loss of profit or opportunity. Customer's sole and exclusive remedy is stated in the manufacturer's end user warranty accompanying the product. In no event shall irepairteam exceed the repair, replacement, or cost of the specific product purchased from irepairteam. The parties agree that the limitations in this section are integral to this order. Some states may not recognize a disclaimer or limitation of warranties and/or limitation of liability so the above disclaimers may not apply. Customers may also have different and/or additional rights and remedies that vary from state to state.
  2. By making this payment or using our services, you accept full responsibility for noticing and alerting to us anything wrong with your device before giving your device to us for repair. You are also repsonsible for noticing anything wrong with your device after repairs are performed, before leaving our office.

    iRepair Team shall not be held repsonsible for any damage or failure that occurs to any part of the device after it leaves our office, except for parts that we replaced or repaired which carry a standard 30 day waranty for failure only. If damage or failure does occur, your device must be covered under our accidental damage warranty plan or the part must be under the 30 day warranty for us to be able to service it at no cost to you."
  3. General.
    (a) These Terms of Sale and any transactions made under them shall be interpreted by and be subject to the laws of the State of Arizona. Should any dispute arise regarding this agreement, Customer consents to jurisdiction in the State of Arizona and agrees that venue is proper in the County of Maricopa. Customer agrees that the place of performance of this agreement is in the County of Maricopa, State of Arizona. Further, the prevailing party in any such dispute shall be entitled to costs including attorney's fees.
    (b) In the event any section or portion of a section of these Terms of Sale are deemed unlawful or unenforceable, that section or portion of a section shall be stricken from the Terms of Sale, and the remaining terms shall continue in full force and effect.
    (c) irepairteam shall not be responsible for damages or delays resulting from Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, riot, seizure, and embargo.
    (d) These Terms of Sale may be modified from time to time by irepairteam without notice, and are current as of the date of the web site. Please refer to the current web site.
  4. Shipping Terms
    Shipping arrangements and costs to return an item are the responsibility of Customer. For any products sold that are damaged, lost, or stolen by carrier in transit to Customer, an insurance claim must be submitted to the carrier, not to irepairteam. irepairteam is not responsible or liable for loss or resulting damage due to carrier's negligence or theft. Delivery times are estimates only and irepairteam shall not be liable for delays. Orders that are refused will be charged a 15% restocking fee.

iRepair Team Warranty Policy

  1. All parts and services provided by irepairteam come with a 1 year limited warranty. This limited warranty covers only defects to the part that was repaired or replaced. For refurbished iPods, the units general operation and wear and tear use. Any accidental damage will not be covered unless added on when purchased. An optional accidental damage warranty is available that covers cracked screens, dead batteries, damaged headphone jacks, hold button switches, the clickwheel. It does not cover the sync port being damaged in any way on the bottom of the ipod. Parts damaged during installation by someone other than irepairteam technicians shall not be covered. Service Performed by a non-irepairteam technician voids the warranty.

iRepair Team Return Policy

  1. Repaired Items That Fail Under Warranty: In the unlikely event that you receive a repaired item that fails under warranty, please obtain an online RMA (return merchandise authorization) before shipping parts back. In all warranty repair cases, we only provide warranty repairs on the specific components that were originally repaired and still deemed under warranty. If irepairteam receives a repaired item back under warranty and finds that additional non-warranty repairs are needed, the customer will be contacted with an additional repair quote.
  2. Non-Defective Returns: All returns must be authorized by irepairteam within 30 days of the invoice date. You may return an item within 30 days of shipment for a full refund. There are no returns after 30 days. We can only accept returns in the same condition and packaging in which they were shipped (e.g., New Factory Sealed items must still be sealed), or else you may be charged a packaging fee. Shipping charges are not refundable, and we do not pay for return shipping.
  3. Defective Returns: irepairteam warrants new parts for 1 year. Service Performed by a non-irepairteam technician voids the warranty. Please obtain an online RMA before shipping parts back.

Terms and Conditions

Please read these terms and conditions carefully so that you fully understand your coverage under this Agreement. If you have any questions, please call 1.888.269-5658

Our limited accidental damage iPhone insurance plan covers the Glass/Digitizer, LCD and Battery on the iPhone 3G and 3GS only. You get 100% Parts & Labor coverage with a low deductible.

Our comprehensive accidental damage iPhone insurance plan covers failures of every component of the iPhone, including damages related to water damage.** (Does not cover logic board failures that are unfixable. We are not obligated to give you a replacement phone if problems caused by water damage are unfixable. See below for exclusions and conditions).

At iRepair Team, we have tried to make our Service Agreement easy to understand. The following summary should help you to quickly find what you need to know about your coverage. It is followed by the actual Service Agreement itself.

IREPAIR TEAM SERVICE AGREEMENT SUMMARY

HOW LONG IT LASTS:

This Service Agreement begins the day you purchase the insurance and lasts for the number of years of coverage you specify at purchase time. If you purchased this insurance over the internet or phone and we have not inspected your phone prior to the insurance purchase, then you must wait 30 days before a claim can be made.

WHAT IS COVERED

LIMITED INSURANCE: Accidental Damage failure only, NOT normal use failure, that occurs to the

iPhone's Glass/Digitizer, LCD and Battery ONLY, from the result of being dropped, crushed, smashed, pulled, pushed or pierced or any such influence on the Glass/Digitizer, LCD or Battery ONLY. If these three different components of the iPhone become cracked, broken or damaged in a way to either not work properly or to be visually cracked, broken, and also if there is a failure of the battery or significant depletion of the batteries life or charging capacity that occurs during normal use of your item, iRepair Team will, at no charge, replace the broken component up to five times per year.

Each of the five claims made per year may include a combination of failures or damages to one or more of the 3 components covered by this insurance.

Each claim made on the iPhone may include all three failures of the components at once covered but we DO NOT ALLOW five separate claims on each of the three components resulting in fifteen claims total. A total of five claims per year is given covering whatever went wrong when one or more of the three components were damaged or became functionally defective.

COMPREHENSIVE INSURANCE: Accidental Damage AND normal use failure that occurs to any part of

the iPhone including any component(except for the back housing or bezel) or part due to the result of being dropped, crushed, smashed, pulled, pushed or pierced, used normally dropped in water or liquid or any such influence. See exclusions below for certain types of liquids and damages not covered.

Accidental Damage coverage begins 30 days after purchase and we must be provided a valid serial number from the iPhone that must be provided at the time of purchase. This insurance does not cover willful damage, negligent use, theft or loss. There is a deductible of $10 for the 3g and $20 for the 3gs.

HOW THE COVERAGE WORKS:

· When an accidental or failure occurs, you must ship your iPhone or drop it off locally to us by appointment only which you must call in and schedule with us prior to your visit. Once you've shipped your item to our service facility, we will repair it the same day ship it back to you at no cost. You only pay to ship it to us. You also pay a small deductible when we receive it. We will contact you about this. It's that simple.

· You may ship your iPhone in using a carrier of your choice.

· If the person making a claim is local to our repair facility, then walk-ins to our location are accepted to make a claim and get repair work done immediately, done while you wait. An appointment must be made with us by phone before coming in to our office for repairs.

· If for some reason, we do not have the part in stock at the moment we have a walk-in visit, then we will make every reasonable effort to obtain a replacement digitizer, LCD or Battery as quickly as possible.

· If mailed in and a part is not available the day we receive it, then we are allowed up to 72 hours to obtain the part needed to fix the iPhone and ship it out.

· We use USPS priority shipping to return your iPhone to you.

WHAT IS NOT COVERED: Refer to the details of the contract for the full list, but there are 5 notable exclusions to your coverage.

We do not cover pre-existing conditions.

· Product failures within the first 30 days: We don't cover items that are dead on arrival or that fail within the first 30 days, unless you purchased the insurance after we have personally inspected the iPhone at our service location.

· (Limited Coverage Only): Accidental damage not related to a cracked Glass/Digitizer, LCD or Battery failure: We don't cover damages to anything else other than cracked Glass/Digitizer, LCD and failure of battery.

· (Limited Coverage Only):We do not cover water damage, cracked or broken housings, bezels, chassis, frames, speakers, microphones, logic boards, headphone jacks, buttons of any kind, buzzer components, cameras, sim cards, sim trays, charging ports, or any other component other than the Glass/Digitizer assembly, the LCD beneath the glass, and the battery inside the iPhone.

· Both Comprehensive and Limited plans: Accessories and Consumer replaceable parts: We don't cover accessories and parts that are meant to be replaced by the consumer such as sim cards, sim trays, cases, covers, sleeves, shades, headphones, ear buds, holders or any 3rd party accessory similar to the ones already mentioned above.

· For the comprehensive plan, we do not cover damage to and will not replace the back chassis or metal bezel on the front of the iPhone.

· We also are not responsible for replacing the logic board or entire iPhone if the iPhone is not functioning properly or at all, due to unfixable or un-repairable issues related to the logic board.

· WE ARE obligated to do everything in our power to repair the logic board due to water or liquid damage but we are NOT obligated to fix the logic board if it is un-repairable and out of our abilities to our service.

· WE ARE NOT obligated to replace any component of the iPhone that is not working due to being dependent on any un-repairable issue of the logic board. This includes parts that are not working independently of the un-repairable logic board or area of the logic board.

· Software: We do not cover software issues, including failure of the operating system, applications, data, music, videos, etc.

DEDUCTIBLES: There is a $10 deductible for our iPhone 3G and a $20 deductible for the 3GS for either limited or comprehensive plans.

REFUND POLICY: We will provide you with a full refund if you cancel your Service Agreement 30 days from purchase of this premium. You can also transfer your Service Agreement at any time at no cost to a different iPhone. If the iPhone is a different model, e.g 3gs, you must pay the difference between the original cost of the insurance and the upgraded model’s insurance cost.

DEFINITIONS:

"We", "Us" and "Our" shall mean iRepair Team LLC. (7150 E. Camelback Rd. Suite 444, Scottsdale, AZ 85251).

WE SHALL NOT BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, PROPERTY DAMAGE, LOST TIME, OR LOST DATA RESULTING FROM THE FAILURE OF ANY PRODUCT OR EQUIPMENT OR FROM DELAYS IN SERVICE OR THE INABILITY TO RENDER SERVICE.

TERM:

1. The term of the Service Agreement for shall be listed on your purchase receipt ("Receipt") commencing on the date of purchase and ending one year from that date. This Service Agreement does not replace the manufacturer's warranty, but provides certain additional benefits during the term of the manufacturer's warranty.

2. If a Product is represented to be under an iRepair Team service agreement and determined to be otherwise, we reserve the right to cancel this Service Agreement and make null and void our services to you and no money will be refunded.

DEDUCTIBLES: There is a $10 deductible for our iPhone 3G and a $20 deductible for the 3GS for either limited or comprehensive plans.

If You purchased coverage on a Product that turns out not to be an eligible iPhone 3G or 3GS, meaning there are pre-existing conditions, the phone was stolen or the serial number was altered to make the phone appear to be the original covered devices, the insurance will be void and no refund will be allowed under any circumstances.

iRepair Team does not provide protection against theft, fire, vandalism, flood, power surge, mysterious disappearance, misplacement, viruses, reckless, abusive, willful or intentional conduct associated with handling and use of the product, cosmetic damage and/or other damage that affects the unit in any other way other than damage to the Glass/Digitizer, LCD or Battery(for limited insurance plan only. See coverage terms for comprehensive insurance in the beginning of this document), or damage caused during shipment between You and our repair facility. If protective items such as covers, carrying cases or pouches, etc., were provided or made available for use with Your product, it is expected that You will continually use these product accessories for protection against damage to the product. Abuse is defined as Your intentional non-utilization of protective items during product use, or Your treatment of the product(s) that You have purchased for Your use in a harmful, injurious or offensive manner that may result in its damage. Any resultant damage from this type of treatment is NOT covered by this program.

WHAT IS NOT COVERED. – LIMITED INSURANCE PLAN ONLY. Difference for comprehensive plan noted.

1. ANY EQUIPMENT LOCATED OUTSIDE THE UNITED STATES OF AMERICA;

2. ANY PRODUCT FRAUDULENTLY DESCRIBED OR MIS REPRESENTED BY THE ITEM SELLER;

3. MAINTENANCE, REPAIR OR REPLACEMENT NECESSITATED BY LOSS OR DAMAGE RESULTING FROM ANY CAUSE OTHER THAN ACCIDENTAL DAMAGE TO THE DIGITIZER/GLASS AND LCD AND FAILURE OF THE BATTERY, WHICH SHALL NOT BE DUE TO WATER OR LIQUID DAMAGE (covered under comprehensive), THEFT, EXPOSURE TO WEATHER CONDITIONS, ABUSE, IMPROPER ELECTRICAL/POWER SUPPLY, UNAUTHORIZED REPAIRS, OPENING OF THE IPHONE OR REMOVAL OF ANY SCREW TO ACCESS THE INSIDE OF THE IPHONE, IMPROPER EQUIPMENT MODIFICATIONS, ATTACHMENTS OR INSTALLATION, VANDALISM, ANIMAL OR INSECT INFESTATION, RUST, DUST, CORROSION, LACK OF MANUFACTURER-SPECIFIED MAINTENANCE, OR ACTS OF NATURE OR GOD OR ANY OTHER PERIL ORIGINATING FROM OUTSIDE THE PRODUCT;

4. COSMETIC DAMAGE TO CASE OR CABINETRY OR OTHER NON-OPERATING PARTS OR COMPONENTS INCLUDING THE GLASS/DIGITIZER AND LCD AND BATTERY WHICH DOES NOT AFFECT FUNCTIONALITY INCLUDING FUNCTIONALITY OF THE THREE COMPONENTS COVERED.

5. INTENTIONAL DAMAGE, LIQUID DAMAGE (covered under comprehensive), ETC., UNLESS ACCIDENTAL DAMAGE DUE TO THE GLASS/DIGITIZER, LCD OR BATTERY.

6. ANY AND ALL PRE-EXISTING CONDITIONS THAT OCCUR PRIOR TO THE EFFECTIVE DATE OF THIS CONTRACT;

7. PRODUCT(S) WITH REMOVED, ALTERED, HACKED, CHANGED, FAKED OR HIDDEN SERIAL NUMBERS IN THE IPHONE SOFTWARE.

8. DAMAGE TO COMPUTER HARDWARE, SOFTWARE AND DATA CAUSED BY, INCLUDING, BUT NOT LIMITED TO, VIRUSES, APPLICATION PROGRAMS, NETWORK PROGRAMS, UPGRADES, FORMATTING OF ANY KIND, DATABASES, FILES, DRIVERS, SOURCE CODE, OBJECT CODE OR PROPRIETARY DATA, OR ANY SUPPORT, CONFIGURATION, INSTALLATION OR REINSTALLATION OF ANY SOFTWARE OR DATA;

9. CHARGES RELATED TO CUSTOMER EDUCATION, CLEANING, PREVENTIVE MAINTENANCE, "NO PROBLEM FOUND" DIAGNOSIS, NON FAILURE PROBLEMS, INCLUDING BUT NOT LIMITED TO, ITEMS NOT COVERED SUCH AS NOISES, SQUEAKS, ETC; INTERMITTENT ISSUES ARE NOT CONSIDERED PRODUCT FAILURES.

10. LIGHT SCRATCHES OR OTHER COSMETIC DAMAGE THAT ARE NOT CRACKS OR BREAKS.

11. FOR THE COMPREHENSIVE PLAN, WE MAY NOT COVER LIQUID DAMAGE IF THE LIQUID THE IPHONE WAS EXPOSED TO WAS LIQUID THAT HAS CORROSIVE PROPERITIES LIKE ACID.

NOTE: THIS SERVICE AGREEMENT MAY BECOME VOID IF YOU MAKE UNAUTHORIZED REPAIRS OR ATTEMPT TO OPEN THE IPHONE IN ANY WAY BE EITHER CRACKING OPEN THE IPHONE OR UNSCREWING SCREWS TO ACCESS THE INTERNALS OF THE IPHONE. (We reserve the right to inspect the Product when we receive it for any claim and to deny a claim if we feel any of our terms and conditions have been violated or if any of the exclusions apply.)

RENEWAL:

This Service Agreement may, at our discretion, be renewed at the expiration of its term. When we YOU offer to renew the Service Agreement, the renewal price quoted will reflect the prevailing service cost at the time of the renewal.

TRANSFER OF SERVICE AGREEMENT:

This Service Agreement may be transferred to any person in the United States or to any other iPhone, as long as it has not pre-existing conditions and meets our terms and conditions. PURCHASER RECORDS:

Although We maintain a record of Your Service Agreement purchase, You must have in Your possession a copy or Your original purchase receipt in order to present a claim if coming in to our service location. If calling in by phone, please have your serial number ready and provide all appropriate information to our representatives to validate your identity.

CANCELLATION:

You may cancel this Service Agreement within 30 days from purchasing an insurance plan, providing you haven’t made a claim yet If you have made a claim before 30 days has transpired, you cannot receive a refund. To cancel your insurance coverage, contact the iRepair Team at 1-888-269-5658 9am-7pm MST M-Thur. Friday 9am – 5pm, and 10am – 3pm Saturday. If You cancel this Service Agreement within the first 30 days after receipt of this Service Agreement You will receive a full refund, where allowed by law.

If We cancel Your Service Agreement, due to reasons not related to fraudulent intentions, activity, or reasons related to violations of these terms and conditions, You will be refunded the unearned pro rata purchase price of the Service Agreement, less any claims paid, where allowed by law.

NOT AS REPRESENTED;

We may cancel this Service Agreement and void any opportunities for refund at Our option on the basis of fraud or misrepresentation.

ENTIRE CONTRACT:

This Service Agreement sets forth the entire contract between the parties and no representation, promise or condition not contained herein shall modify these terms. We reserve the right to modify the terms and conditions at our discretion. Our up to date terms and conditions will be posted online at www.irepairteam.com/termsandconditions.
